Rules for buying and selling goods in the APATITE.LT online store
1. General provisions
1.1. These rules for the purchase and sale of goods (hereinafter "Rules"), after they have been approved by the Buyer (after familiarizing themselves with the Rules and ticking the box next to the statement "I have familiarized myself with the rules of APATITE.LT and I agree with them"), are a binding legal document for the parties, which determine the Buyer's and Seller's rights and obligations, conditions of purchase and payment for goods, order of delivery and return of goods, responsibility of parties and others related to the purchase and sale of goods Provisions related to the APATITE.LT online store.
1.2. The Seller reserves the right to change, amend or supplement the Rules at any time. Registered Buyers will be informed of any changes, corrections or additions when logging in to the APATITE.LT page and will be required to confirm the Rules again. The change of the Rules is valid only in relation to those ordered goods that were submitted after the change of the Rules. This version of the rules is valid from 2014. on May 15 and it replaces all previous versions of the rules that were valid for orders in the APATITE.LT online store.
1.3. In the APATITE.LT online store, sales are carried out only in the areas specified in the "Product conditions" section.
1.4. Active natural persons have the right to buy in our online store; minors between the ages of fourteen and eighteen, only with the consent of their parents or guardians, except in cases where they dispose of their income independently; legal entities.
2. Protection of personal data
2.1. APATITE.LT has the right to collect and process personal data provided by the Buyer to APATITE.LT and, if necessary, to disclose them to third parties when it is necessary for order fulfillment, data processing or APATITE.LT activity planning and analysis. APATITE.LT also has the right to use the Buyer's personal data for the purposes of advertising and providing information to the Buyer within the scope of APATITE.LT's activities. The buyer's data can be used for sending information or for other online store activities only after obtaining the buyer's consent (after familiarizing himself with the Rules and ticking the box next to the statement "I have familiarized myself with the APATITE.LT rules and I agree with them"). The buyer has the right to prohibit the collection and processing of his personal data at any time, except when it is necessary for the fulfillment of the requirements arising from the Purchase and Sale Agreement or the fulfillment of the Order. Data about Buyers and visitors of the online store are protected against loss, unauthorized use and alteration. Data carriers are fully protected against access by third parties.
3. Entry into force of the purchase-sale agreement
3.1. The contract between the Buyer and the Seller is considered concluded from the moment when the Buyer, after choosing the product(s) to be purchased and creating a shopping cart, clicks on the "Pay" link.
3.2. APATITE.LT is not obliged to separately notify the Buyer of its agreement to enter into a contract. It is considered that APATITE.LT confirms the order from the moment it starts executing it.
3.3. Each purchase-sale contract concluded between the Buyer and the Seller is registered and stored in the database of the APATITE.LT online store.
4. Buyer's rights
4.1. The buyer has the right to purchase goods in the APATITE.LT online store in accordance with the procedure established by these Rules and the online store.
4.2. The buyer has the right to withdraw from the contract for the purchase and sale of goods concluded with the APATITE.LT online store by notifying the Seller in writing (by e-mail, specifying the item to be returned and its order number) no later than within 14 (fourteen) working days from the day of delivery of the item , except in cases where the contract is concluded for
4.2.1. supply of cosmetics, perfumery, household chemicals and hygiene products;
4.2.2. goods that were manufactured taking into account the personal needs of the Buyer or according to the conditions provided by the Buyer;
4.2.3. food products, if the Buyer was sold a food product of suitable quality and the product's shelf life has not expired;
4.2.4. goods that cannot be returned due to their characteristics, including perishable and expired products;
4.2.5. in other cases, when the contract of purchase and sale cannot be refused, according to the laws of the Republic of Lithuania.
4.3. The Buyer can use the provided right only if the product has not been damaged or its appearance has not fundamentally changed, nor has it been used. Rules 4.2. The Buyer's right provided for in point is implemented in accordance with the Minister of Economy in 2001. August 17 by order no. 258 of the approved "Rules for the sale of goods and provision of services when contracts are concluded using means of communication".
5. Obligations of the buyer
5.1. The buyer must accept the goods in accordance with the procedure established by these Rules and pay the agreed amount for them.
5.2. If the data provided in the Buyer's registration form changes, he must update it immediately.
5.3. The buyer undertakes not to transfer his login data to third parties. If the Buyer loses his login data, he must immediately inform the Seller about this via the means of communication specified in the "Contacts" section.
5.4. The buyer, using the APATITE.LT online store, undertakes to comply with these Rules and not to violate the legal acts of the Republic of Lithuania.
5.5. If the Buyer, during the delivery of the goods, refuses to accept the goods without valid reasons, the Buyer must cover the costs of delivery of the goods.
6. Seller's Rights
6.1. If the Buyer attempts to harm the stability and security of the online store or violates his obligations, the Seller has the right to immediately and without warning limit or suspend his access to the online store or, in exceptional cases, cancel the Buyer's registration.
6.2. In the event of important circumstances, the Seller may temporarily or completely terminate the online store without notifying the Buyer in advance.
6.3. The Seller has the right to cancel the order without notifying the Buyer in advance, if the Buyer, having chosen non-cash payment methods, does not pay for the goods within 3 (three) working days.
6.4. When the Buyer chooses cash as the payment method provided at the time of delivery of the goods, the Seller, in case of uncertainty regarding the information provided in the order, contacts the Buyer by the phone number specified in the order. In this case, the term of delivery of the goods starts counting from the day of contact with the Buyer. The Seller has the right to cancel the order without prior notice to the Buyer if the Seller fails to contact the Buyer within 3 (three) business days.
6.5. APATITE.LT has the right not to conclude a Purchase-Sale Agreement with a specific Buyer who placed an order in all cases, including, but not limited to, cases where the Buyer refused the Purchase-Sale Agreement and returned the goods 2 or more times in the last 12 months.
6.6. APATITE.LT has the right to refuse the concluded Purchase-Sale Agreement if the stock of the goods specified in the agreement has run out, as well as if the agreement was concluded by a person who, based on these Rules, did not have the right to conclude the agreement.
7. Obligations of the seller
7.1. The Seller undertakes to enable the Buyer to use the services provided by the APATITE.LT online store under the conditions set out in these Rules and the online store.
7.2. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by him and under the conditions specified in these Rules.
7.3. The Seller, unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to offer an analogous or similar product as far as possible. If the Buyer refuses to accept an analogous or the most similar product, the Seller undertakes to return the money paid to the Buyer within 3 (three) working days, if prepayment was made.
7.4. The Seller undertakes to respect the Buyer's privacy right to his personal information, specified in the online store registration form, except for the cases established by the laws of the Republic of Lithuania.
8. Product prices, payment procedure and terms
8.1. The prices of goods in the online store and in the formed order are indicated in litas with VAT. APATITE.LT reserves the right to change the prices of goods in the event of a change in tax amounts or the ratio of Litos (LTL) to Euros (EUR).
8.2. In the event of a change in the official exchange rate of Litas and Euros (at the time these Rules are drawn up, the official ratio of Litas and Euros is equal to 1 EUR = 3.4528 LTL) all APATITE.LT online store prices and all purchases and sales transactions concluded with APATITE.LT shall be transferred to the Buyer's wallet obligations in Litas are recalculated according to the new exchange rate so that the amount payable by the Buyer in Euros is equal to the amount in Euros calculated according to the old Lito and Euro exchange rate at the time the Rules were drawn up
8.3. The buyer pays for the goods in one of the following ways:
8.3.1. Payment by bank transfer is an advance payment when the Buyer, after printing the order and going to the nearest bank branch or simply using the online banking system, transfers the money to one of APATITE.LT's bank accounts.
8.4. When paying by the payment method provided in point 8.3.1, the Buyer undertakes to pay immediately. In the above-mentioned cases, only after receiving the payment for the goods, the preparation of the goods parcel begins and the calculation of the delivery term of the goods begins.
9. Delivery of goods
9.1. The goods are delivered by the Seller or his authorized representative.
9.2. The Seller undertakes to deliver the goods to the Buyer in accordance with the terms specified in the product descriptions. These terms do not apply in cases where the necessary goods are not available in the Seller's warehouse, and the Buyer is informed about the shortage of the ordered goods. At the same time, the Buyer agrees that in exceptional cases the delivery of goods may be delayed due to Force Majeure circumstances.
9.3. When ordering the goods, the buyer undertakes to indicate the exact place of delivery of the goods.
9.4. The buyer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer does not have the right to make claims to the Seller regarding the delivery of the goods to the wrong entity.
9.5. During the delivery of the goods, the Buyer must check the condition of the shipment together with the Seller or his authorized representative. If the buyer signs the invoice (bill of lading) or other document of shipment transfer - acceptance, it is considered that the shipment has been delivered in a suitable condition.
9.6. The delivery fee and more detailed information related to the delivery of the goods can be found in the "Delivery conditions" section of the online store.
9.7. In the event that the Buyer, on the basis of these Rules, refuses the purchase-sale contract, he is obliged to pay all the direct costs of returning the goods to the Seller. The amount of these costs of the Seller is deducted from the money paid for the goods to be returned to the Buyer.
9.8. If it is not possible to deliver the ordered goods in one shipment, APATITE.LT has the right to deliver the goods in several shipments.
9.9. In all cases, the Seller is released from responsibility for the violation of the terms of delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the Buyer's fault or due to circumstances beyond the Buyer's control.
10. Product quality guarantee and expiration date
10.1. All goods are subject to the manufacturer's warranty terms. If the product breaks down during the warranty period, the repair is done free of charge. The seller does not provide warranty service for goods, referring the Buyer to a warranty service center in each specific case.
10.2. The characteristics of each product sold on APATITE.LT are generally indicated in the product description attached to each product.
10.3. The seller is not responsible for the fact that the color, shape or other parameters of the goods in the online store may not correspond to the real size, shape and color of the goods due to the characteristics of the display used by the Buyer.
10.4. In the event that the Seller does not provide a quality guarantee for certain types of goods, the guarantee provided by the relevant legal acts shall apply.
10.5. The Seller undertakes to sell the goods to the Buyer in such a way that he is given a real opportunity to use such goods until the end of the shelf life. In the case of particularly short warranty periods, the products in the online store are marked with a special warning sign.
 
11. Return and exchange of goods
11.1. The return and exchange of goods is carried out in accordance with the 2001 regulation of the Minister of Economy. June 29 by order no. 217 approved "Rules for return and exchange of items" and the Minister of Economy in 2001. August 17 by order no. 258 of the approved "Rules for the sale of goods and provision of services when contracts are concluded using means of communication".
11.2. The Buyer can exercise the right to return and exchange the goods within 14 (fourteen) working days from the day of delivery of the goods, informing the Seller about it in the manner provided for in Clause 4.2 of the Rules.
11.3. The returned product must be in its original, neat packaging, undamaged by the Buyer, without losing its appearance as a product (labels intact, protective film intact, etc. (this clause does not apply in the case of a defective product being returned)), in the same configuration as the Buyer received, necessarily when presenting the goods purchase document and warranty card (if it was issued).
11.4. The Buyer can deliver the returned goods himself to the address in Alytus, on working days from 09.00 to 19.00 hours, or send them using courier services. In case the product is returned based on 4.2. The Buyer bears the costs of returning the goods. When the received wrong product and/or low-quality product is returned, the Seller undertakes to take such products and replace them with similar suitable products. In case the Seller does not have similar goods, he returns the money paid for the goods to the Buyer.
11.5. The Seller has the right not to accept the goods returned by the Buyer, if the Buyer does not follow the procedure for returning the goods established in this article.
12. Marketing measures applied by the seller
12.1. The seller, at his discretion, can initiate various types of promotions in the APATITE.LT online store, in other APATITE.LT-managed trading places (exhibitions, fairs), in the APATITE.LT account on the social website Facebook and in any other informational means.
12.2. When initiating certain promotions, under the conditions specified in such promotions, the Seller can provide Buyers with a virtual APATITE.LT discount code, which can be used to receive discounts for goods purchased in the APATITE.LT online store.
12.3. The seller has the right, after informing the buyers beforehand, to change the conditions of the promotions by his unilateral decision, as well as to cancel them, to change the procedure for granting the APATITE.LT discount code and its use when paying for goods. Any changes initiated by the Seller to the conditions of promotions and the procedure for granting and using the APATITE.LT discount code (including cancellation) apply only to the future, that is, they are valid from the moment of their implementation.
12.4. The specific conditions of certain promotions initiated by the Seller, which are specific only to those specific promotions, are defined in the communication tools of these promotions.
13. Liability
13.1. The buyer is fully responsible for the correctness of the data provided in the registration form. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for the resulting consequences.
13.2. The buyer is responsible for the actions taken while using this online store.
13.3. The buyer is responsible for the transfer of his login data to third parties. If the services provided by APATITE.LT are used by a third person who has connected to the online store using the Buyer's login data, the Seller considers this person to be the Buyer.
13.4. The Seller is released from any responsibility in cases where the losses arise because the Buyer, regardless of the Seller's recommendations and his obligations, did not familiarize himself with these Rules, although he was given such an opportunity.
13.5. If the Seller's online store contains links to the websites of other companies, institutions, organizations or individuals, the Seller is not responsible for the information or activities carried out there, does not supervise or control those websites and does not represent those companies and individuals.
13.6. In the event of damage, the guilty party compensates the other party for direct losses.
14. Exchange of information
14.1. The Seller sends all notifications to the e-mail address provided in the Buyer's registration form.
14.2. The buyer sends all messages and questions using the means of communication specified in the "Contacts" section of the Seller's online store.
15. Final provisions
15.1. Relations arising on the basis of these rules shall be governed by the law of the Republic of Lithuania.
15.2. All disagreements arising from the implementation of these rules shall be resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
